Possible Prospects for the Employee Retention Tax Credit

The Ebola Response Coalition is among the most effective relief efforts for the spread of the coronavirus. The ERC's primary focus is on financially assisting companies, especially smaller ones.

ERC might be viewed as a bonus given to companies that are successful in keeping their full-time workers on board. A qualifying business can keep the money that would have gone toward certain payroll taxes. Qualified earnings are beneficial to calculate an employer's allowable retention. Earnings paid to employees in 2020 and the first three months of 2021 are considered qualified wages.

Employers can get instant credit by deducting a certain amount of qualified wages from their quarterly tax returns. Sounds good? Even though the ERC is a wonderful program for small business owners, many haven't taken its benefits yet.

Employee retention credit and PPP, both programs, were amended simultaneously. But because of the lack of knowledge and awareness of the ERC program, some employers are still struggling to claim it.

Eligibility Requirements

To be eligible to apply for the ERC, employers must fit into one of these categories.

Any employer who has employed w-2 employees and has less than 500 employees overall can check against this criterion-

  • Due to government-imposed restrictions, employers who have to shut down their business operations partially or fully ( in 2020) can apply for the ERC.

  • Also, employers who have faced a significant decline in annual gross receipts compared to the previous years can apply for the program.

Except sole proprietorships, all firms must adhere to the requirements. However, a sole proprietor who employs others can apply on their behalf.

Remember that the ERC does not accept applications from companies with more than 500 workers. If your company has many locations, you may not have more than 500 people working at any one location.

Can I Still File for the Claim?

We are now two years into the future (2022) and hence two years into the existence of the ERC program. So, if you're wondering if now is a good time to apply, the answer is yes.

You can file for the ERC credit with your quarterly tax return using form number 941. It will let you get instant credit. However, understanding the requirements and complying with them can be tricky, so it is always best to take expert advice. You can seek help from an ERC consultant who will help you decode the criteria and smoothly apply for the program. But make sure you choose a legal consultant or ERC tax service to avoid any issues.

Changes That Happened Over The Time In This Program And May Let You Qualify This Time

Multiple shifts have occurred at ERC. In light of this, a company that initially did not meet the program's requirements may now be able to apply. Let's examine the significant shifts ERC has undergone since it was first established so that we may make sense of the present-day criteria:

The Conscientious Adoption and Safe Sleep Policy Act

The CARES Act is responsible for the development of ERC. It validates the business for tax purposes and for reimbursement of medical costs. Included in this calculation was the time span between March 12, 2020, and January 1, 2021, payroll.

ARP of 2021

Compensation owed to employees from June 30, 2021, through January 1, 2020, is covered by the 2021 ARP. The term "recovery startup business" was also included among those who might apply for ERC funding.

IRS Notice 2020-22, 2020-17, and IRB 664

These three notices penalize employers who have failed to deposit employment taxes. This applies to all qualified employers under the Families First and CARES Act.

Infrastructure Act § 80604 Amendment

The amendment applies to wages paid during June 30-October 1, 2021. It also extends the definition of a recovery startup business and removes all the requirements that made recovery startups previously not eligible.

We have attempted to list the major changes to the ERC but have not included all in the list. Please consult a tax expert or ERC consultant to know about the changes.
